If you are involved in an auto accident and receive medical care for your injuries, you should use all available resources to pay your bills. This would include submitting your bills to your health…
My girlfriend and I were involved in a car accident several months ago. A woman ran a stop sign and t-boned us as we were crossing a two-way stop intersection. I was released from therapy a couple months ago, and the lawyer is trying to get the maximum 15k the other woman’s insurance is willing to pay. My girlfriend recieved a release settlement letter from the lawyer of 15k (the maximum injury claim settlement the woman’s insurance covers). My girlfriend, who is still in therapy, thinks it’s practical to just take the settlement. But I think she should pursue further suit (personal suit) because of unforeseen damages and future injuries relating to the accident. So here’s my question…
Should she settle or pursue a personal suit? And if she does pursue personal suit, what can she expect in terms of settlement, negotiations, time, etc?
Please share experiences. Any legal advice is appreciated. Thank You.

A little over a year ago, I backed into my 23 month old daughter with the our car. A few months later our car insurance called and offered to settle her claim for $850. We were suprised that my daughter would get anything since I was the one that hit her. Our insurance explained that it was just like her getting hit by someone else, or me hitting another child. We wanted to make sure all her medical bills were being taken care of and our car insurance said yes they would. But we found out they didn’t know everything she had been through and what her injuries were. Now our car insurance has all the bills and the medical reports from the hospitals that she went to. Tomorrow they are suppose to call and offer a new settlement. My wife called around to both hospitals and both ambulance companies that we used and all the bills were about $10,000. Were not greedy, but we want to make sure my daughter gets all the money she should. That’s what the insurance is for after all.
On my work-related injury that happened to my head and face, my case still open. Yet the hospital already sent me the bills during the treatment in E/R. Fortunately the Working Comp insurance adjuster said that the insurance will pay the bills, so I need to forward my med.bills to theirs.
The adjuster even recommends me go to the nearest Medical Doctors from the lists he faxed me (total of 10 pages of the local family practices near me).
However, though, my big concern is, would it be possible that I also can get some cash settlement…..at least to cover all of the extraordinary expenses related to my work injury? How long does it take [to get the final settlement] without a lawyer? Is the final settlement negotiable or just as it is?

End of July had bad car accident. Air bags deployed, car was totalled (insurance co. already paid property damage – other guy was at fault), but now there will be a medical settlement. The injuries were mostly large, nasty bruises and abrasions on arms and chest from air bags and seat belt. Went to the doctor, now pretty much healed, altho lot of pain for a time…couldn’t pick up a cup for instance. The adjuster is coming to see us (my grandaughter was injured, too), and I know he’s going to make an offer, but it will probably be small. I am retired, so no wage loss was incurred, but hey! It HURT! And I lost my car for over a month. I perform the function of “gramma-taxi” daily for my family and it was very stressfu not having a car plus dealing with the injuries. I don’t want a lot – after all – we all have to pay for insurance claims, but I don’t want to be mistreated either. And, I don’t want to contact our attorney, really. Just wanna deal with it fairly. Any suggestions?
Does this sound familiar? You have been injured in a car accident, a work incident, or any other kind of accident that has caused you personal pain. You understandably want to get your medical bills paid for, and you want compensation for the pain that you are suffering. On top of that, you’ve been off work. Perhaps you own a small business and your incapacitation has resulted in lost productivity. What do you do and where do you turn?
Well don’t worry, because there are many people out there who will help you. In fact, they went to law school to be able to do so. They are called personal injury lawyers. They want to help you feel right again, get your life back, plus get the compensation that you deserve.
Personal injury lawyers are injury experts. You might even call them accident lawyers. Certain states don’t allow you to be compensated if you have contributed to your injury. However, good personal injury lawyers know how to present cases in the best possible way to result in the best possible outcome.
Also, they know all the intricacies of personal injury law. They can help you find parts of your policy that apply to your case that your insurance company probably won’t tell you about. They also know how much compensation to ask for. They won’t settle for any less than they feel is attainable, because they follow similar cases and know how much you case is worth.
Don’t forget, one of the main reasons to hire a personal injury expert is because with the assistance of a lawyer, you can threaten to take your case to court. Most insurance companies would rather settle than go to court, and a good lawyer will know the how much pressure to apply before the breaking point. They will know exactly how to play the game and still get you a settlement.
There are many more reasons why hiring a personal injury lawyer is a good idea. Their intimate knowledge of the law, and their knowledge of the insurance companies, will ensure you get a favorable settlement. A personal injury is a terrible thing to endure, and the lawyers will help make sure the responsible party fairly compensates you for the trouble and pain of your injury.
You shouldn’t try to take on the insurance companies by yourself. Get a personal injury lawyer to assist you as you navigate the complexities of the system. You won’t regret it, especially when you discover a hefty settlement check waiting for you in your mailbox.

Allstate has offered me $110,000 as an injury settlement. Almost 3 years ago I was the passenger in an accident where the driver blew a .12 . I sustained lasting injuries to my right (dominant) hand and elbow as well as minor significant head abrasion. The pinky finger on my hand is fused at the last and middle joint and shows significant deformity ( as do most of the fingers to some extent) I have mallet finger on my middle finger and my index finger’s top knuckle is fused. I have stiffness in all the joints that do move in that hand. My elbow was gashed open and has a horrible scar as well as loss of range of motion to a small degree. It does hurt if I put even a little weight on it( such as resting my head on my elbow while sitting at a table) I was also out of work for about 4 months and suffered a considerable amount of pain. My health insurance and auto insurance are looking for a combined $20,000 reimbursment. I figure since the drivers liabillity insurace tops out at $250,000 and I would be getting back about $130,000 with the insurance reimbursment factored in that leaves them making out with $120,000. Is it worth 30% (lawyers fee) of that $250,000, assuming I would get the max, in hiring a lawyer. I figure that would net me about $150,000, $40,000 more but a lot more headache. I had a medical consultation by a hand specialist who said I lost about 41% use of my right arm. I am also still able to work and have adapted to still be able to play violin, guitar, and hockey. I’m not looking to get rich just don’t want to get ripped off. thanks for any help.

I was a passenger in a car accident two weeks ago. My only injury is a stiff neck. The insurance company of the at-fault driver has offered me $500 to settle. Should I accept it or fight for more (for example, by threatening to sue)? Should I see a doctor and bill the insurance company for that, even though I wouldn’t normally see a doctor for this injury? I’m not really concerned about the seriousness of the injury; the pain will probably go away eventually. I just want to get the amount of money I deserve.
I recieved a dog bite almost a year ago and hired an attorney quickly as the owner of the dogs was not willing to compensate me for my injuries. The owner also refused to give out their homeowner’s insurance information, so I had to get an attorney to force them to give it up. I have been recieving medical treatment for my injuries and have a nasty scar on my breast. My attorney wants me to meet with them and the Insurance company to show them my injury in person. I have never heard of this being done before and I don’t know if this a smart move on my attorney’s part. Plus, I am very self conscious of the way my breast looks and don’t like the idea of exposing myself to strangers. To my knowledge no settlement or agreement to do so has been put forth. Is this normal? What should I do?
