My girlfriend and I were involved in a car accident several months ago. A woman ran a stop sign and t-boned us as we were crossing a two-way stop intersection. I was released from therapy a couple months ago, and the lawyer is trying to get the maximum 15k the other woman’s insurance is willing to pay. My girlfriend recieved a release settlement letter from the lawyer of 15k (the maximum injury claim settlement the woman’s insurance covers). My girlfriend, who is still in therapy, thinks it’s practical to just take the settlement. But I think she should pursue further suit (personal suit) because of unforeseen damages and future injuries relating to the accident. So here’s my question…
Should she settle or pursue a personal suit? And if she does pursue personal suit, what can she expect in terms of settlement, negotiations, time, etc?
Please share experiences. Any legal advice is appreciated. Thank You.

The statute of limitations runs out on July 5,2008 for my personal injury case in Tennessee, and we have not yet gotten a first offer from the claims adjuster. The last time my lawyer got a hold of him he said that he was waiting on a medical report that he requested because he thought my bills was to high and he wanted another doctor to look over it or something, but he said he was getting the report back last week and we still haven’t heard anything. My question is, Is this a normal, do insurance companies wait till the last minute to settle or do you think they are wanting to go to trial? Also this is a third party insurance company and the guy that hit me was 100% at fault..Thanks for any info
the other party admitted the fault and i went to emergency room twice for my injury. the claim adjustor of the other party insurance company is trying to settle the case for small amount of money. i don’t want to obtain a lawyer’s help as much as possible.
I was involved in a car accident june 21st 2008 this year.. i was driving down the street and when a suddenlywithout hesitation a car reversed out of a parking lot at rapid speed and hight the front right corner of my car.. Damages: Hood, Right Fender,Right Headlight, Front Bumper Lip, Engine Bay Framing, and Front Tie Rod ends..
Totally could not drive it home i own a mitsubishi lancer oz rally
so today they told me that the other guys insurance is going to pay for my damages to the car .. so i went to the body shop to sign off on the papers that say that body shop is going to make repairs to my vehicle..
i didnt go to the hospital but i am going to pain management therapy and i just did a MRI .Neck Back Lower Back , Shoulders and Right arm.
Hurting ever since the accident..
I have no points on my license .. i had never had a car accident this is my first and only accident i had.
Any Idea of what amount i should expect to get .. the lawyer will be taking a 3rd of my settlement..
is $35,000 a reasonable amount to consider?
can we claim for settlement? we had a car accident 10 days after the car was bought. the car was under the name of our friend but we are financially responsible for it.meaning we pay for the monthly dues,deposits.etc. We have an insurance for our 2 cars meaning we are insured drivers but that car was not yet in the policy. the accident is not our fault but we are claiming for settlement due to bodily injuries.
