I was in a car accident about 3 years ago. I wasn’t at fault (no fault state anyways) and the other driver was ticketed. I went to the hospital the same day and then of course to physical thearpy for a year and now we are in negoiation stage. $10,000 was offered by State Farm for my injuries; my lawyer put in a conter-claim for $55,000. My medical bills are up to $9,000. What I want to know is, I know my lawyer gets her 1/3 off the top of whatever I end up with and since I had no medical insurance or car insurance will the medical facility that did my PT and pain managment will that come out of the check right off the top or will I have to pay them on my own? In other words, who will have their hands in my pockets first besides the lawyer? I live in FL if that helps any. (And of course I was hit by an 81 year old woman in a brandy new Lexus. Gotta love FL). Thanks ahead of time.
