Yucaipa Personal Injury Lawyer’s Top Ten Things You Don’t Want to See Your Doctor Do After Treating Your Accident Injuries

1. Have a couple of shots of scotch.

2. Saying, “Why me.”

3. Calling for a priest.

4. Wringing his hands.

5. Yelling at the nurse for giving you the wrong medication.

6. Ordering a stomach pump for you.

7. Calling Code Blue.

8. Calling for the police.

9. Asking the nurse how they mixed up the surgical orders.

10. Telling the nurse to shred your chart.

Now here are ten useful tips of advice from a personal injury lawyer to follow if you have been in an accident. You can also learn more about how to handle a personal injury in Yucaipa, or any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com  and learning how we can assist you.

Obviously, if you have had an accident, and you are reading all of this advice, it’s probably been at least a few days since the accident. However, if it’s only been a few hours or if you ever have another accident, here’s what you should do the next time from the start.

First, take a look around and determine if you or anyone, are hurt. If so, taking steps like trying to prevent further injury or loss of blood are the most important thing you can do. Even if some other driver caused you to be injured, it’s just good manners to help the other driver if they are hurt. They may even be so thankful that they admit their fault to you. The worst thing you can do is get angry or start a fight.

Second, make sure everyone is safe from being injured further. If you are in the middle of traffic, and you are dizzy, sit down away from traffic. If your vehicle is a traffic hazard and you have accident warning devices like flares or triangles, put them out on the road to warn other drivers and get away from the car. Let the police an other emergency personnel investigate the scene with the vehicles in place and move them more safely at a later point.

Third, call the police. Accident reports are extremely helpful if the police will do such a report. Let the police know you are injured immediately. Answer the police questions honestly. But if you are dazed or confused, let them know you need medical treatment and answer only what you feel sure about. Remember, your statements can and will be used against you if you admit fault, and it will be too late and too fishy to later say you didn’t know what you were saying at the scene. Police know that your best recollection is immediately after an accident.

Fourth, get the other driver’s information including their names, addresses, driver’s license numbers, make and model of their vehicles, license plate numbers, and their insurance company name and policy number. If there are witnesses, get their names, addresses and telephone numbers as well. If the other driver makes any admissions of fault, write those down as well.

Fifth, if you have a camera on your cell phone or in the car and you aren’t too injured, take some photos of the vehicles and the scene. If you can’t do it right away, do it after you are released from the hospital.

Sixth, if you are hurt, obtain medical treatment. Don’t decline the ambulance or hospital examination to save your insurance company money or to be stoic. Take your valuables out of your car if you can and get checked out at the hospital. If you are not hurt, don’t get treatment you don’t need. However, remember, after an accident, you may feel a rush of adrenaline that causes you to only start feeling symptoms of pain a few hours later. If you have a health plan that requires you to obtain permission first, call them and find out where you are allowed to seek treatment.

Seventh, call a good personal injury lawyer as soon as you have had your initial treatment, so the attorney can gather other important evidence and prevent the insurance company from taking advantage of you and obtaining such things as recorded statements that you feel fine, when many of your symptoms have yet to manifest themselves. A good personal injury lawyer can save you from making a great deal of mistakes and can shoulder much of the hassle of knowing what to do about car repairs, car rentals, medical treatment, witness statements and the like. If you think you will save money by not having an attorney, think again. A good personal injury attorney can almost always obtain much higher settlements, obtain reductions of medical bills and insurance liens and prevent you from making costly mistakes. Also, most personal injury lawyers advance costs of obtaining police reports, medical records and the like and are paid and reimbursed for these costs only out of any settlement.

Eight, you will need to report the accident to your insurance company, but since they will want to take a recorded statement from you, just like any other driver’s insurance company, it’s good advice to retain an attorney first. And if the other driver did not have insurance, remember that it is your own insurance company that will be your adversary. You will also need to report the accident to the Department of Motor Vehicles and your lawyer can give you the form for this.

Ninth, do not agree to settle your claim privately with the person at fault for the accident. This almost never works out to your advantage. Don’t agree not to call the police. Police reports that determine the fault for an accident are golden. Your agreement to not involve the police only affords an opportunity for the other driver to change his story and blame you when the police will no longer investigate the accident.

Tenth, don’t pay a traffic ticket without a fight if you weren’t at fault or agree to accept a small payment for your vehicle repairs without knowing that the amount will in fact cover the cost of all the repairs.

If you’ve had a personal injury in Yucaipa, Calimesa, Lake Arrowhead, Big Bear Lake, Crestline, Cherry Valley, Banning, Beaumont, Colton, Loma Linda, Grand Terrace, San Bernardino, Redlands, Moreno Valley, Hemet, Perris, Colton, Highland, Riverside, Fontana, Apple Valley, or anywhere in Southern California, we have the knowledge and resources to be your Yucaipa Personal Injury Lawyer and your Redlands Personal Injury Attorney. Be sure to hire a California law firm with auto, motorcycle, truck, bicycle, pedestrian, car, bus, train, boat and airplane accident experience, wrongful death experience and insurance law expertise who can ensure you are properly represented and get the compensation you deserve.

If you have a personal injury legal matter, a dog bite or if you’ve lost a loved one in a wrongful death accident, call the Law Offices of R. Sebastian Gibson, or visit our website at http://www.SebastianGibsonLaw.com  and learn how we can assist you.

My Wife Was In An Auto Accident W/the Other Party At Fault. Had Questions About Her Injuries & Insurance?

The other party failed to yield the right of way entering an intersection. She was issued a citation for the accident and has current auto insurance. My wife suffered first degree burns on her arms and also back and neck pain. Her vehicle looked totaled with the front end completley caved in. Her vehicle is a 2004 Nissan Exterra with 40000 miles and it was almost paid off. We live in TX. My questions are… How much would she recieve to replace her car? Will she get a rental car to drive in the mean time? How long till this gets resolved? Should we expect a settlement for her injuries, lost wages, hospital bills? and should we look into hiring a personal injury lawyer or just let the insurance company handle it? I’d appreciate any insight thank you.

Does An Insurance Company Have To Pay You For Lost Wages From Injuries To Do A Car Accident?

On Dec. 18, a drunk driver crossed the yellow line and hit me. Does his insurance company have to pay me back for lost wages since I cannot work due to injuries. If so, is that money added to the settlement or do they pay me on a weekly bases like my work would? I need to know because I am a college student with bills to pay, but I have NO income right now because of this. If they don’t owe it to me now, is there a way they can help me pay my bills?

Hit And Run Accident Injuries Settlement?

My family (wife daughter) first day on vacation…..sitting at left turn lane, red light, drunk driver slams into us from the rear at 40 mph, totally destroyed front end of his car, but somehow slammed it into reverse and took off across intersection. Cop sitting at intersection saw the whole thing and catches this PIECE OF chit. He is arrested an charged with at least one felony. We all have back and neck injuries (no not faking them, they are real. Get hit at 40 mph and see how you feel) go to hospital, xrays negative for bone fractures, but we all have whiplash , headaches back pain.
How do I proceed with insurance co. going forward? Is the settlement higher because he was drunk and ran, charged with felonies, or does this matter. Can i also personally suit him? I want this FUC to pay, he almost kiled my daughter and she was the most seriously injured. Any advise is appreciated.

Compensation from Truck Accident Injuries

Truck accident injuries are typically quite severe. The size and momentum of a truck can often devastate a small passenger car and the occupants inside the car. Truck accident injuries are frightening, often have long recovery times, and cost tens of thousands of dollars if not more. Truck accident injuries usually require the legal representation of a qualified and experienced truck accident lawyer in order to gain a fair injury settlement or file an injury lawsuit. Dealing with truck accident injuries can take a tremendous toll on the victims.

Injury lawsuits are commonly filed by truck accident lawyers when there has been reasonable injury to either the driver or the passenger of the smaller vehicle. This is normally done within a short period of time from the date of the accident, although in some cases such as injuries that refuse to heal or turn into surprisingly big ordeals, the injury lawsuit may be filed at a later time.

Of course, there is a statute of limitations which applies to the time limits of filing injury lawsuits, so most truck accident victims speak with a truck accident lawyer as early as possible. This helps to ensure the rights of the victim or victims and yet still allows for time for the extent of the injuries to surface.

There have been a small percentage of injury lawsuits filed by truck accident lawyers that deal only with emotional injury. Initially, these injury lawsuits were not given credibility. However, over time it has been recognized that there is a small percentage of individuals who were so terribly traumatized that they were rendered incapable of driving a motor vehicle for an unreasonable length of time.

Emotional trauma has gained credibility as a viable trauma that can affect a daily life and a livelihood just as much as physical trauma in some cases. These injury lawsuits were fought by pioneering truck accident lawyers and set a remarkable precedent for those who followed.

Many injury lawsuits pertaining to truck accidents deal with both physical injury and emotional trauma. It has been proven by numerous truck accident lawyers that a physical injury can take up to twice as long to heal when it is compounded by an emotional trauma. Being trapped in a vehicle underneath a big rig certainly counts as emotional trauma.

Truck accident lawyers now typically tend to send the majority of their clients to see a counselor or psychologist to determine the extent of emotional trauma as well as to physicians and specialists to determine the extent of the physical trauma. This is not an attempt by the truck accident lawyer to rake the trucking company over the coals, but an attempt to keep the best interest of the client in the forefront of the injury lawsuit. Some clients don’t realize the extent of their emotional trauma until after they see a mental health professional.

Injury lawsuits tend to be an emotional stressor themselves, and a high quality truck accident lawyer may very well recommend counseling even if emotional trauma is not part of the injury lawsuit claim. This is to help the client manage their emotional trauma related to the accident to help them remain calm and under control in a court room setting.

Many clients who refuse this treatment option do not realize how affected they were by the accident until they are in a court room explaining the details of the accident to a room full of people. Their emotions sneak up on them and many lose their composure within minutes. Thus, for the emotional protection of the client, the vast majority of truck accident lawyers recommend counseling after a truck accident.

Truck accidents are very serious, and filing an injury lawsuit is a serious action to take against a trucking company. They are a large company with a lot at stake, and thus they will bring forth a highly equipped and skilled legal team. Prior to ever filing an injury lawsuit, the client needs to be sure of the facts of the case as well as find a truck accident lawyer they feel is qualified to go up against a legal team that specializes in this type of defense.

It is always recommended that a potential client put in their due diligence before hiring a truck accident lawyer to take their case into an injury lawsuit. There is quite a bit at stake for the claimant as well. The less emotional stress the claimant encounters, the more likely their injuries are to heal quickly and properly. This also means the more confidence the client has in the truck accident lawyer, the less emotional stress the claimant is likely to experience.

Should I Let An Insurance Company See My Injuries In Person Before A Settlement Has Even Been Offered?

I recieved a dog bite almost a year ago and hired an attorney quickly as the owner of the dogs was not willing to compensate me for my injuries. The owner also refused to give out their homeowner’s insurance information, so I had to get an attorney to force them to give it up. I have been recieving medical treatment for my injuries and have a nasty scar on my breast. My attorney wants me to meet with them and the Insurance company to show them my injury in person. I have never heard of this being done before and I don’t know if this a smart move on my attorney’s part. Plus, I am very self conscious of the way my breast looks and don’t like the idea of exposing myself to strangers. To my knowledge no settlement or agreement to do so has been put forth. Is this normal? What should I do?
