How Can I Get Insurance Company To Offer Fair Settlement?

I was rearended in my new 4-day old car. 3rd party insurance company paid to fix my car, but I had neck and back injuries. After 4 months of treatment, including PT and numerous doctor visits and loss of time from work, I provided the insurance company with a demand letter and all the medical information and loss of work documentation they requested. Now they are low-balling me with a settlement offer which is less than 10% of what I was demanding. So far they have refused to budge from their offer. My last letter threatened legal action, but I would prefer to settle and move on. How can I get them to increase their offer? I currently live in GA and I am within statute of limitation.

What Would Be A Fair Settlement For My Injuries?

I lady hit my car on the drivers side of my car she ran the stop sign. I had to be taken to the hospital by ambulance. Is This Insurance Settlement Fair?

My son was in a car accident last year. The passenger hit a telephone pole and my son sustained a knee injury. He has a partial ACL tear. Initially it was thought to be a meniscus tear and he has surgery for that. When they did the surgery, they found it was an ACL tear which they will not fix surgically unless he tears it all the way. Med bills were 4500. The insurance company offered 9500, 4500 of it to cover medical bills. He is 17 years old and we live in OH. I am handling without an attorney.

Insurance Settlement….does This Seem Fair?

I was in an accident in Jan 08 where a driver hit my car while changing lanes not once but 2x’s. He said he didnt see me and admitted he was at fault.
His insurance paid for my car repairs and rental right away.
I had two injuries. One to my collar bone, I had a huge half grape fruit size lump comming off of it for about 3 weeks and a moderate to severe neck injury that caused a pinched nerve.
I went to physical therapy twice a wk for 8 wks and went to a massage therapist, for only once a wk for 8 wks as a suggestion by my PT that it works well in tandum. I was in severe pain, not being able to turn my head for almost a month…which sucks since I am a photographer and I had to turn over 3 weddings to an associate.
What they have offered is to pay medical bills, not massage therapy and 1200.00 for my “time and inconvenience.
I dont know how they came up with that # since I have lost 3000.00 + from turning over the weddings, and 1100.oo massage therapy.
Does 1200.00 seem faiR?

My wife was in an acident, received hearing loss, weakness, and stiffness injuries. She can not go to movies or concerts because the noise hurts her ears. Her left side has weakenss and she can not turn her head all the way to the left. Our health insurance paid all of her claims. If we settle, will our health insurance expect to be paid from the settlement? The other person’s insurance is trying to settle with us for $31,000. They have already paid for her totaled car. Does this seem fair?

How to Get a Fair Insurance Settlement

 

Natural disasters such as wildfires, hurricanes, tornados, and floods have been making headlines. We’ve seen hundreds of homes go up in flames in southern California; thousands of homes battered by hurricanes and tornados in Texas and the south; and thousands more submerged by the mighty Mississippi and other swollen rivers. These catastrophes play themselves out over and over. The locations may change but the story is the same: heartbreaking devastation.

While wildfires, catastrophic storms, and floods cause widespread damage, the nation’s homes are regularly damaged by less ominous forces: baseballs that break windows; stovetop fires cause smoke damage ; burst pipes damage walls, flooring, and furnishings. Other regular homeowners insurance claims include fire, theft, vandalism, mold, hail damage, water damage, and more. Throughout the nation, homeowners regularly file insurance claims, even in the absence of catastrophe.

No matter what has damaged your home, if it’s covered by your insurance policy, you can rest easy knowing that it will be taken care of – or can you? Insurance companies are businesses that need to make a profit in order to survive. Part of that profit comes from premiums and another part comes from minimizing insurance losses.

One way to minimize insurance losses is to limit what they will cover. For example, life insurance companies will likely deny a life insurance policy to a 98-year-old smoker with emphysema. After all, that would be an unnecessary risk and a bad investment, unlikely to turn a profit.

Be assertive and proactive. When the adjuster visits your home, point out the damage and ask him to look for hidden damage. Make sure the adjuster does a thorough inspection. If possible, have a third party contractor, like a roof inspector (if you need roof repairs), present. The contractor will be able to point out damage that the insurance adjuster may not have noted otherwise.

Depending on the scale of your home’s damage, you may want to hire a public insurance adjuster to represent your interests. In addition, you might consider a “do-it-yourself” insurance claims kit to better arm yourself for the insurance claims battle ahead.

I Was Rear-ended, With $1000 Damage To Bumper And A Neck Injury. What Is A Fair Settlement?

I was rear-ended in May. I have been going to physical therapy approximately 3x per week for an injury to my neck. My insurance company has been paying for the physical therapy, minus a deductible and small copays. There was approximately $1000 damage to my rear bumper. What would be considered a fair settlement?
